Lawyers’ right in Taiwan are based on the laws of ROC in exile. Since 1895, no Chinese government has any sovereignty over Taiwan. Even since 1945, ROC in exile lead by Kai-shek Chiang is issued by the general order by Supreme Commander for the Allied Powers General Douglas MacArthur on September 2, 1945. Based on Order and Memorandum of United States District Court on March 18 (Case # 06-1825), 2008, San Francisco Peace Treaty is factual document. In other words, United States of America is the “Principal Occupying Power” over Taiwan and people of Taiwan should be the residents of United States of America. It is wrongful citizenship for Taiwanese people as citizens of ROC in exile and also wrongful sovereign Taiwan by ROC in exile.

For the last sixty-three years, there is no justice in the justice system in ROC in exile over Taiwan. It is almost impossible to reverse any political issues in court decided by a small extreme group in KMT and ROC in exile. Deep in their mind the laws are just a weapon to attack and incarcerate their political enemies. In other words, they can manipulate the laws what ever they want. Thus it is useless trying to negotiate and fight the laws written by them within ROC in exile.

If justice system cannot be independent from administrative system and legislative system, it is impossible for people to have the fundamental human rights. Without fundamental human rights, any sentence within that justice system can be distorted and contaminated by third parties influences.

Because last sixty-three years KMT and ROC in exile do not want people of Taiwan to know the real history of Taiwan, people of Taiwan are learning wrongful information without knowing that information is not correct. If you are going back to read San Francisco Peace Treaty, Taiwan Relationship Act, Roger Lin v USA and so on, you will find out who you are, what is the position of Taiwan now and what destiny of Taiwan will be.

If you full understand above questions and answers, I believe you won’t fight the justice within the justice system of ROC in exile. To fight within a wrong system is like to walk on the wrong direction. It is impossible to reach your goal.
