沒有Ph.D不代表你不能走專利這條路.

但有了Ph.D, 對專利事業的發展是有正面的效果.

Ph.D要不要去國外拿呢? 要的.

主要的原因是到一個英語環境去訓練自己的英語工程寫作能力.

台灣的工程教育缺乏寫作訓練.

大學的教育偏重計算和解題.

大學沒有教我們去表達和敘述工程問題.

因為缺乏寫作訓練, 台灣專利的內容通常缺乏邏輯性.

把請求項超到說明書內, 其是一個很偷懶的寫法.

到美國念LLM, 最重要的還是英文.

來之前要把英文準備好.

儘管TOEFL高分, 但是要在美國進入狀況, 還是要吸收更多的英語.

Youtube, on-line newspapers都是不錯的管道.

如果你英文不好, 一到美國, 人家會把你看扁.

華大每四年會舉辦美國總統或副總統的辯論會。在這樣的場合中，我們有機會為台灣發聲。相信你已經透過New York Times看到今年副總統辯論會的轉播。

我觀察的學校對於辯論會的佈置，想到一些可能的行動方式。事實上，我個人當天穿著「逆轉勝T-shirt」看看是否可以被媒體拍到。我不會再待四年，但是我的想法可以延續，等到四年後，看看有沒有機會做些事。

你如果工作久了，想換換環境，去考個TOEFL/GRE，來申請念華大的博士班。華大不收博士班的學費，反而給你錢花。很好吧！這邊住和吃都比較低消費。

來美國念JD卻目標中國就業市場的錯誤認知

如果你目標來美國念JD，心中卻想著自己可以進攻美國法律服務產業的中國業務市場，那你就大錯特錯了！

你知道有多少中國人來美國念JD嗎？光是Washington University in St. Louis School of Law的中國人JD就有快二十位，本校每年會產出只少五個中國人JD。但是全美產生的中國人JD不只來自本校。很多學校都有直接考LSAT去念JD的中國人。所以，你認為就算美國事務所要找人拓展中國市場，他們會聘你台灣人，還是只會考慮中國人。想想吧！

所以，還是看看自己如何用台灣來在美國找工作。台灣是美國IP法律服務業支撐之一，所以不用懷疑，IP是來美國念JD的唯一理由。台灣將是你找到工作的基礎！

美國的法律專業學位基本上是設定為博士學位，其英文為「Juris Doctor」而簡稱為J.D.。法學院另外有提供學術研究為導向的博士學位，英文為「Juris Scientiae Doctoris」而簡稱為JSD。這二個學位的差異在於，前者有嚴格的修課標準，前者可讓你考美國所有州的律師，也是律師事務所會聘用你的條件。後者則是純學術研究，沒有修課義務，但必須要提出論文和通過口試才得以取得學位。

JD的起薪在比較好的事務所是每年16萬美金，中型事務所也有年薪12萬美金以上的收入。

JD和JSD原則上在台灣都是被承認的博士學位。不過如果要到學校任教，持JD者要再配上國內的LLM學位（例如我在政大法科所的學位）。這差異的來源是國內法律界認為讀JD並未在訓練研究和撰寫學術論文（當然，這不是事實。）。

If you come here for an LL.M. degree and later decide to go on for a JSD, you may start to write your proposal in the first semester. The school only reviews your first semester GPA. And if you find a supervisor, you are deemed to be admitted.

Abandonment of Lawful Permanent–Resident Status

§ 2[a] Background, summary, and comment—Generally

An alien with permanent-resident status, also sometimes referred to as an "LPR" or "green card holder," has been "lawfully accorded the privilege of residing permanently in the United States as an immigrant in accordance with the immigration laws."[FN1] This status may only be removed if an alien is determined to have committed a deportable offense[FN2] or an offense making him inadmissible under the Immigration and Nationality Act,[FN3] or if the alien "abandons" his residence in the United States.

An alien is, of course, not precluded from leaving the United States for short visits abroad. The Immigration and Nationality Act (INA) provides that a resident alien who returns from being abroad may be readmitted for entry into the United States, at the Attorney General's discretion, without needing a passport, visa, reentry permit, or other special documentation, as would otherwise be required.[FN4] (筆者註：馬英九的綠卡有沒有效要看美國政府的裁量。)

To qualify as a returning resident alien, an individual must have previously acquired lawful permanent-resident status, retained that status from the time it was acquired, and be returning to an unrelinquished lawful permanent residence after a "temporary visit abroad."[FN5]

If an alien has been abroad for a lengthy period of time, however, his commitment to permanently residing in the United States is called into question. Abandonment of permanent resident status is generally found when there has been a lengthy absence from the United States. Whether an alien has abandoned his status is a matter of subjective intention proven by objective facts, the ultimate issue being whether there is a continuing intent to return. Whether there was an intention to maintain permanent-resident status is not the issue, but rather whether there was a continuous, uninterrupted intention to return to the United States. We have previously recognized the widely disparate views of what constitutes a “temporary visit abroad.” See Tejeda v. INS, 346 F.2d 389, 393 n. 3 (9th Cir.1965). And we have cited with approval at least the portion of the Second Circuit's test in United States ex rel. Lesto v. Day that classifies a visit as temporary so long as it is “for a period relatively short, fixed by some early event.” See Alvarez v. District Director of United States Immigration and Naturalization Service, 539 F.2d 1220, 1224-25 (9th Cir.1976); Gamero v. INS, 367 F.2d 123, 126 (9th Cir.1966). We now turn to consider the question of whether a visit can be classified as temporary when, as in United States ex rel. Polymeris v.
