Best Mode: Great Northern Corp. v. Henry Molded Products, Inc. 94 F.3d 1569 (Fed. Cir. 1996)

4. Adequate Disclosure: Great Northern Corp. v. Henry Molded Products, Inc. 94 F.3d 1569 (Fed. Cir. 1996)

The best mode inquiry has a two-fold test. One is to determine whether the inventor subjectively contemplated such a best mode of practicing the claimed invention before the filing date. Two is to determine whether, objectively, the specification adequately discloses that best mode such that those having ordinary skills in the art could practice it.

“Production details” is not of the best mode requirement. It has two senses. One is commercial considerations. The other is the details related to the quality or nature of the invention, but not necessary because the detail is routine.
