§ 2[a] Background, summary, and comment—Generally
An alien with permanent-resident status, also sometimes referred to as an "LPR" or "green card holder," has been "lawfully accorded the privilege of residing permanently in the United States as an immigrant in accordance with the immigration laws."[FN1] This status may only be removed if an alien is determined to have committed a deportable offense[FN2] or an offense making him inadmissible under the Immigration and Nationality Act,[FN3] or if the alien "abandons" his residence in the United States.
An alien is, of course, not precluded from leaving the United States for short visits abroad. The Immigration and Nationality Act (INA) provides that a resident alien who returns from being abroad may be readmitted for entry into the United States, at the Attorney General's discretion, without needing a passport, visa, reentry permit, or other special documentation, as would otherwise be required.[FN4] (筆者註：馬英九的綠卡有沒有效要看美國政府的裁量。)
To qualify as a returning resident alien, an individual must have previously acquired lawful permanent-resident status, retained that status from the time it was acquired, and be returning to an unrelinquished lawful permanent residence after a "temporary visit abroad."[FN5]
If an alien has been abroad for a lengthy period of time, however, his commitment to permanently residing in the United States is called into question. Abandonment of permanent resident status is generally found when there has been a lengthy absence from the United States. Whether an alien has abandoned his status is a matter of subjective intention proven by objective facts, the ultimate issue being whether there is a continuing intent to return. Whether there was an intention to maintain permanent-resident status is not the issue, but rather whether there was a continuous, uninterrupted intention to return to the United States. 馬英九應立刻公布他取得美國綠卡的經過
馬英九不顧台灣民眾的食品安全，斷然開放美國牛內臟進口。而且此決策並未經過行政院，而是以國安會主導來和美國進行談判。令筆者不得不懷疑，這樣隱密的決策是否又和馬英九的美國永久居留權或甚至是其具有公民身分的問題扯上關係。自馬英九參選總統以來，他都未能提出綠卡失效的書面證明文件，這已經是相當不符合常理。因此，國內有不少人懷疑馬英九事實上有美國公民身分。可是這種種的懷疑都無法被馬英九以提出相關文件的方式來澄清。對此，筆者認為馬英九應該公布他取得美國綠卡的經過。此類資訊公開的意義在於，我們可以按照時間去推斷當時的美國移民法律和政策，進而可以判斷馬英九是否有美國公民身分。筆者要強調的是，有美國公民身分不一定代表他有美國護照。特別是馬英九的狀況可能是在他取得美國公民後，因為在台灣任官，而未能回到美國申請護照。

當了多年的官 有甚麼國際法著作 或是可以讓他到政大教書的著作
沒有 馬英九對國際法根本是個空殼子
政大法律有蘇永欽 一個支持檢察官羈押權的憲法學者
董保城 一個主張以特別權力關係還宰制學生言論自由的憲法學者
最近 董保城還主張 中國人可以考公務員 真是太白癡吧
超級保守 又是統治者一家
選擇政治法科所時 這是一個考慮要件
不過 還好可以不需要去上蘇和董的課
不然 就太倒楣了

出國念博士
出國念書真應該是一個生為台灣人的必要志業.
每個台灣人都應該出國去一趟.
在這樣的認知下, 就應該好好計畫培養自己語言能力.
特別是英語寫作能力.

由蔡守訓的判決, 看要不要去念法律.
看到蔡守訓的判決, 決定要去念法律的人要有一個基本的認知.
追求正義, 第一個志願不是去念法律.
想有邏輯訓練, 也不用去念法律.
蔡守訓的判決, 沒有法律論證, 沒有證據引用.
就是一份寫爽的判決.
蔡守訓一個月十幾萬.
爽官.
馬英九說不定還會給他當高等法院法官.
辦公室可以配平面電視.

比阿扁還失敗的馬英九
選前說我們已經準備好了. 大喊馬上好, 633. 選後卻改口馬上漸漸好, "633"也看不到.
經濟沒起色, 但由於阿扁實在是太令人失望, 使得馬英九還是可以有人可以比.
這次風災, 其實是馬英九可以重新贏得人民信心的時機.
如果他能夠在第一時間內, 站出來承擔責任, 相信多數人還是可以繼續容忍他.
但令人不解的是, 他既然放棄這個機會.
把風災問題丟給民進黨的縣市長.
他知道這些縣市長的救災經驗有限, 手邊也沒有任何資源.
他不跳出來, 反而怪縣市長沒能力.
可是馬英九實際上也沒證明他自己的能力.

Prior to practicing law, Sophia was the lead of Gene Expression Technology group at Monsanto Company, where she oversaw and coordinated molecular and bioinformatic discovery for targeted gene expression. At Monsanto, Sophia also led a product development team and supported regulatory approval, commercial product launch and strategic planning. She then obtained her joint JD/MBA degrees from Northwestern Law and Kellogg with an emphasis on biotechnology and pharmaceutical industry. Sophia is also a coauthor of many scientific publications and co-inventor on two pending patents in the area of regulation of gene expression.
